The SMX Agreement

Welcome to smx.co.za. By using our website, you agree to the rules outlined below. We have kept them simple, straightforward, and fair, because we believe mutual respect is the foundation of any great relationship.

1. The Contract of Sale

  • Order Acceptance: When you place an order, it is an offer to buy. A binding agreement is only formed once we have checked our inventory, verified payment, and sent you a dispatch confirmation email.
  • Stock Availability: We hunt for unique, interesting products. Because many items are rare or limited, stock is subject to availability. If an item sells out before we can fulfill your order, we will notify you immediately and issue a full refund.

2. Pricing and Payments

  • Accuracy: We work hard to ensure all prices on smx.co.za are accurate. In the rare event of a clear typographical error, we reserve the right to cancel the order and issue a full refund.
  • Payment Methods: We accept secure, encrypted payments via our authorized payment gateways. Orders will only be processed once funds have cleared.

3. Returns and Refunds

  • The 14-Day Window: If a product does not meet your expectations, you have 14 days from the date of delivery to return it to us.
  • Condition: To qualify for a return, the item must be unused, in its original undamaged packaging, and in the exact condition you received it.
  • Defective Items: If an item arrives damaged or faulty, we will collect it, inspect it, and replace it or refund you completely at our expense, in full compliance with the Consumer Protection Act (CPA) of South Africa.

4. Intellectual Property

  • Our Content: The design of this website, the logos, the text, and the curated imagery belong to SMX. You are welcome to share our site with friends, but copying our code, layout, or content for commercial use without our permission is strictly forbidden.

5. Limitation of Liability

  • The Service: We provide smx.co.za on an "as is" basis. While we strive for perfection, we cannot guarantee the site will always be online, error-free, or uninterrupted.
  • Liability: SMX will not be held liable for any indirect, incidental, or consequential damages arising from your use of our website or the products purchased through it.

6. Governing Law

  • South African Jurisdiction: Because SMX is rooted in South Africa, these terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes will be settled in South African courts.
